De presentatie en notulen van de creditors meeting van 24 november zijn online geplaatst op de bekende locatie.

Deposit Claim on behalf of DNB
Principle amount: EUR 1.635.873.676,03 (ISK276.838.902.194,56).
Recognised: EUR 1.634.846.745,48 (ISK276.665.114.737,58).
Claim of interest: EUR 135.555.421,00 (ISK22.940.043.895,83).
Approved: EUR 28.287.683,15 (ISK4.787.124.619,47).
DNB made a principal claim for Icelandic penalty interest as provided for in Article 5 of Act No.38/2001 on interest and price indexation. This claim was rejected by the Winding-up Board of LBI on the grounds that Dutch law applied to this matter.
- Icesave terms and conditions stated clearly that Dutch law applied to the deposits.
As a secondary claim in the alternative, the DNB claims default interest as provided for in the Dutch civil code, specifically on the basis of Rules 6:119a and 6:119.
However, the Winding-up Board did agree to DNB’s claim for agreed contractual interest according to the applicable terms. TheWinding-up Board of LBI calculated contractual interest on deposits until 22 April, with the start date for the interest calculations determined by the date of transfer by the deposit holder of his / her claim to DNB, i.e. the date of receipt by the transferor of payment from the transferee.
DNB claim for costs was rejected as it had not been shown to have legal merit.

Wholesale Deposits partially paid by DNB
Included in the claim were payments of €780.401 which DNB stated it had paid to 26 Dutch Wholesale depositors. According to the documentation provided to the Winding-up Board, 3 of the depositors received €100.000 in compensation and the remaining 23 received €20.887. Insufficient data was provided to allow for reconciliation of payments to these 26 depositors so the entire amount is considered to be un-reconciled.

In the claim forms, DNB notes that it is in dispute with 11 depositors in respect of DNB’s obligation to pay them.
Samenvattend kun je dus verwachten dat de volledige afronding nog jaren gaat duren. 11 mensen hebben blijkbaar van DNB geen vergoeding gekregen en zijn daardoor nu in een juridisch conflict terecht gekomen. Ook zijn er blijkbaar 23 ondernemingen / instanties die wel geld van DNB hebben gekregen, maar waarvan de curator nu zegt dat dat niet terecht was.
Verder lijkt het inderdaad zo te zijn dat er gemiste rente uitbetaald wordt tot 22 April (dan wel tot het moment van ontvangen van het geld).

•The Winding-up Board received a total of 832 claims from depositors in LBI’s Dutch branch.
– The largest part of these claims was claims for the amount notcovered by the Dutch deposit scheme.
Every individual depositor was entitled to a maximum payment of 100.000 Euros from the Dutch deposit scheme.
Two individuals, with joint accounts could obtain a payment to maximum of 200.000 Euros, provided that both accountholders had submitted a claim.
– Furthermore, a considerable number of claims were received where the claim was only for interest.
The assignment to DNG was limited to the payment as made by DNB. DNB paid interest to 13 October 2008.
Payment by DNB was normally made at a late date and some depositors claimed interest for the intervening period.
• The Winding-upBoard’s decisions on the individual claims are as follows :
– 412 claims were accepted with amendments.
– 111 claims were rejected in their entirety.
• Depositors with over 100.000 Euros.
Claims for that part of the deposit that was above the amount reimbursed from DNB including interest.
The Windingup Board has applied the following method :
– The principal amount of a claim is reconciled against the LBI data.
– Interest up to and including 22 April 2009 :
• Calculated for the amount of 100.000 Euros from 13 October 2008 and until the DNB paid to the claim antin question. (?)
• Calculated for the principal amount less 100.000 Euros from 13 October 2008.
–The interest applied is 5,25% per annum, which is the interest rate applicable to the deposits according to the terms of the Icesave accounts on 13 October 2008.
• Interest claims.
Many of the depositors, who were reimbursed in full from DNB for the depositbalance at 13 October 2008, claimed from LBI’s estate remaining interest for the period from 13 October until the time of payment from DNB.
In these cases the Windingup Board applied the same principles as described before.
Kopieren uit de sheet gaat niet helemaal goed. En het is me te laat om dit nu met de hand overal bij te werken
In ieder geval goed nieuws. Veel van de 100k+ mensen krijgen hun geld (grotendeels?) terug.
Ook de mensen die een geldige! claim voor gemiste rente hebben ingediend krijgen deze uitbetaald.
